These Terms & Conditions (“Terms”) govern all services provided by Amplify Studio, a Colorado Limited Liability Company (“we,” “us,” or “our”). By using our services, making a payment, or participating in onboarding, the client (“you” or “client”) agrees to be bound by these Terms.
1. Scope of Work
We provide branding, website design, website development, hosting, and digital marketing services tailored to home service businesses. Specific project agreements or proposals will define deliverables, pricing, and timelines.
2. Refund & Cancellation Policy
2.1 Website Development Services
Design Phase Refunds: Clients may request a refund only during the design phase. Once the design is approved and development begins, no refunds will be issued.
Development Phase: By approving the design, you acknowledge the project is non-refundable due to the time, resources, and custom work required.
2.2 Hosting, SEO & Marketing Services
Hosting, SEO, advertising, and other marketing-related services are non-refundable once the service period begins.
Clients may cancel by providing 14 days’ written notice via email. Services will continue until the end of the billing cycle.
No partial refunds are provided for unused time or paused campaigns.
2.3 Exceptions
Refunds outside the above policies are granted only at our sole discretion.
3. Client Responsibilities
To ensure project success, you agree to:
Provide all requested materials, content, and feedback within 7 business days of each request.
Maintain consistent communication throughout the project.
Not intentionally cause unreasonable delays.
If the client:
Fails to respond for 14 consecutive days, or
Delays the project intentionally or through neglect,
then any money-back guarantee is void, and the client remains responsible for all fees incurred.
4. Scope Changes & Additional Work
Only the work outlined in the signed proposal is included.
Revisions beyond the agreed rounds or additional feature requests are billed separately.
Extra work is billed at $25/hour unless otherwise agreed in writing.
5. Payment Terms
By making payment, you accept these Terms & Conditions.
Deposits and payment schedules are outlined in your proposal or invoice.
All payments are non-refundable after the refundable phase ends (see Section 2).
Late invoices incur a 1.5% monthly fee (18% annual) or the maximum allowed by law, after a 7-day grace period.
Accounts over 30 days past due may result in suspension of services. Accounts over 60 days past due may be sent to collections. The client is responsible for all collection costs and legal fees.
Outstanding balances remain due regardless of client-caused delays.
Once a website is live, a recurring hosting fee of $99/month will be automatically invoiced and is required for continued operation.
6. Revisions
Each project includes up to 3 rounds of revisions unless otherwise stated.
Additional revisions are billed separately.
Revision rounds apply only before final design approval.
7. Termination
Either party may terminate the agreement with written notice. Upon termination:
Refunds follow Section 2.
The client remains responsible for all work completed to date.
Abandoned projects (per Section 3) are non-refundable.
8. Ownership & Intellectual Property
Ownership of final deliverables transfers to the client only after full payment is received.
Until full payment, all project assets remain our intellectual property.
We reserve the right to showcase completed projects in our portfolio and marketing.
9. Limitation of Liability
We are not liable for:
Delays caused by client inaction or non-responsiveness.
Loss of profits, business interruptions, or indirect damages.
Consequential or incidental damages.
Results impacted by incomplete, inaccurate, or late client-provided input.
10. Governing Law
These Terms are governed by the laws of the State of Colorado. Disputes will first be resolved through good-faith mediation. If unresolved, disputes will be settled through binding arbitration in Colorado.
By making payment or engaging with Amplify Studio, you confirm your acceptance of these Terms & Conditions.
